Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Spicule when you install, access, or use PodCopilot ("the Service"). By using the Service you agree to these Terms.

1. The Service

PodCopilot is a desktop application that automates podcast publishing workflows. It is licensed, not sold, under the LICENSE file at github.com/spiculedata/podcast-manager/blob/main/LICENSE.

4. Acceptable use

You agree not to use the Service to violate any law or third-party rights, reverse engineer the Service, generate unlawful content, attempt to access another user's data, resell or sublicense access, or probe/scan the Service's infrastructure.

5. Third-party services

PodCopilot integrates with Anthropic, Transistor.fm, Late, Buffer, Firebase, and Stripe. You are responsible for complying with the terms of those services. We are not responsible for their outages, moderation decisions, or pricing changes.

6. AI-generated content

PodCopilot uses Anthropic's Claude models to generate titles, chapters, show notes, and social posts from transcripts you provide. You retain ownership of inputs, are responsible for reviewing AI-generated outputs before publishing, and accept that AI outputs may contain errors or fabricated facts ("hallucinations"). Spicule provides no warranty as to accuracy.

7. Your content

You retain all rights to content you upload to or generate with the Service. You grant Spicule a limited licence to process that content solely as needed to provide the Service. We do not use your content to train AI models.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party providers.

The Service may automatically download and install updates. You can disable automatic updates in settings. Updates are signed and verified before installation.

11. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be excluded by law.

12. Indemnification

You agree to indemnify Spicule against any third-party claim arising from your breach of these Terms, your use of the Service in violation of applicable law, or content you publish using the Service.

13. Termination

You may terminate by closing your account at any time. We may terminate or suspend access for breach of these Terms, prolonged inactivity (>12 months), or where required by law. Sections 7, 10, 11, 12, and 14 survive.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that consumers resident in the EU/UK may invoke mandatory consumer-protection laws of their country of residence.

15. Changes

We may amend these Terms. Material changes will be announced with at least 14 days' notice where practicable.
